STATEMENT ON THE CONFIDENTIALITY OF PERSONAL DATA

This is our Privacy Statement regarding registration in the National Registry of Voluntary Hematopoietic Stem Cell Donors (NRVHSCD). The statement sets out how we commit to keeping the personal data you provide us safe and managing it in accordance with the legal provisions in force regarding the protection of personal data. Our Privacy Statement for personal data is available for reading at the headquarters of NRVHSCD and at the partners in the network of healthcare units that carry out activities coordinated by NRVHSCD, as well as on our website at www.registru-celule-stem.ro.

NRVHSCD, in accordance with the requirements of EU Regulation no. 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) undertakes to protect the personal data of the data subjects and to comply with the applicable legal and regulatory provisions regarding their protection.

Your personal data is safe with us. The security of your personal data is very important to NRVHSCD and in our relationships with processors, third parties and all stakeholders and we comply with all security requirements. We are committed to being transparent and open. This privacy statement explains how we handle your personal data from the moment we hold it until its deletion and destruction.

 

PURPOSE OF DATA PROCESSING

NRVHSCD is a personal data controller, for the purpose of:

  1. creating and managing a computer database on the territory of Romania regarding individuals who have given their consent to donate stem cells for an unrelated patient, from the country or from abroad, containing personal, medical and histocompatibility data and for information purposes, health services and scientific research;
  2. identifying compatible hematopoietic stem cell donors for patients with a prescription for hematopoietic stem cell transplantation;
  3. providing information to similar bodies from abroad, regarding the identification of compatible hematopoietic stem cell donors from the country for patients from abroad;
  4. scientific research in the field of bone marrow transplantation.

We process the personal data collected by NRVHSCD and for which you have given your consent and it helps us to determine the degree of compatibility with patients who have an indication for transplantation and allows us to contact you, if it turns out that you are potentially compatible. The processing is done by automated means. Of the personal data collected, some are part of special categories of data, such as information about your health status, ethnicity, blood group and tissue type. Through predictive statistical techniques, we use your data, including sensitive personal data, in order to identify the best match between a patient and donors registered with NRVHSCD.

If you are selected as a match for a patient awaiting a transplant, we use your personal data to communicate with you about the stages of the donation process. We will also contact you to update your contact details or whenever necessary to ensure your availability as a potential donor.

 

WHAT PERSONAL DATA DOES NRVHSCD PROCESS?

When you consent to enroll in the NRVHSCD, we collect personal information such as: name, date of birth, ethnicity, blood type, tissue type, contact information, information about your health, and a sample to determine your HLA tissue type.

If you are a potential match and we are unable to contact you, we may contact the contacts you have provided or your family doctor.

 

RECIPIENTS OR CATEGORIES OF RECIPIENTS OF PERSONAL DATA

We will never sell or transfer your personal information to third parties for their marketing purposes. We may need to share your information with any entities that acquire rights within our organization through merger or reorganization, with law enforcement agencies and/or regulatory entities to comply with any legal obligations or court orders.

The recorded information is intended for use by the operator for the specified purposes and is transmitted to the following recipients:

  1. Local blood transfusion centers and health units where donor recruitment activities are carried out;
  2. Blood group and Rh testing laboratories, virological testing and histocompatibility testing laboratories;
  3. Hematopoietic stem cell collection centers;
  4. Bone marrow transplant centers;
  5. Similar international organizations, subject to compliance with Romanian and European Union legislation. These parties may be located anywhere in the world where different laws regarding the confidentiality of personal data apply and you understand and fully agree that these similar international organizations may use personal information only if they have established adequate levels of protection for personal data or always act in accordance with applicable laws regarding the confidentiality of personal data.

 

RIGHTS OF THE DATA SUBJECTS

You should be aware that according to EU Regulation no. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, you have the following rights: right to information and transparency, right of access, right to rectification, right to erasure (right to be forgotten), right to data portability, right to restriction of processing, right to object, right to withdraw consent, rights in relation to automated decision-making and profiling, right to lodge complaints. You can request information about the personal data we hold, as well as details of how we use it, at any time by contacting us directly. We aim to respond to any genuine request, but we would like to inform you that we have the right to refuse to act on your request. Please consider your requests carefully before sending them to us. We will respond to them as soon as possible. The response deadline is 30 days from the date of receipt of the request, but if the resolution of your request requires an extension of this deadline, we will notify you of this fact.

PERSONAL DATA SECURITY

We implement appropriate technical and organizational measures against unauthorized or unlawful processing of personal data and against accidental loss, destruction or damage to personal data.

Although we take appropriate measures to ensure the security of data and information communicated via the website, no computer system connected to the Internet can be absolutely secure against intrusion. Therefore, we cannot and do not guarantee that information communicated to us via the website will be received or that it will not be altered before or after transmission to us. If you choose to use the website to communicate with us or to transmit information to us, you do so at your own risk.

HOW LONG WILL WE KEEP YOUR PERSONAL DATA?

The information you provide to us will be kept for the period necessary to achieve the purposes mentioned in point 1 in accordance with the requirements of the legislation and regulations in force. We will apply reasonable measures to destroy or anonymize the personal information we hold if it is no longer necessary. You will remain registered in the NRVHSCD until you reach the age of 60, unless you wish to revoke your consent to be a potential donor of hematopoietic stem cells. You can request the personal information we hold, as well as details of how we use it, at any time by contacting us directly. Personal data will be processed at least once during the maintenance of your status as a potential donor of hematopoietic stem cells. Personal data will be stored for as long as necessary for the purposes mentioned above or for the period of time provided for by the legal provisions in force (30 years from donation/transplant).

Your refusal to process personal data makes it impossible for NRVHSCD to collect, store, process and transmit this information.
